These Terms of Use (the "Terms") govern your access to and use of the website located at andersoncollege.com (the "Website") operated by Anderson College of Health, Business and Technology Inc.( "Anderson College," "we," "us," or "our"). By accessing, browsing, or submitting information through the Website you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website.
1. Eligibility and Account Responsibility
The Website is intended for prospective students, current students, alumni, employers, and the general public. If you submit personal information you represent that (a) the information is accurate and complete; (b) you are at least 16 years of age, or, where you are younger, that your parent or legal guardian has consented to your use of the Website and to the collection of your information; and (c) you will keep any login credentials we may issue confidential and not share them with any third party.
2. Permitted Use and Prohibited Conduct
You may browse the Website for personal, non-commercial informational purposes only. You agree not to:
- Copy, republish, resell, or commercially exploit any material on the Website without our prior written consent;
- Use automated systems (bots, scrapers, crawlers) to access or index the Website — the Website is not intended for public search indexing;
- Circumvent, disable, or otherwise interfere with security-related features of the Website;
- Upload or transmit any virus, worm, malicious code, or attempt to overload, disrupt, or compromise the Website or its underlying infrastructure;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Submit false, misleading, defamatory, obscene, hateful, or otherwise unlawful content through any form on the Website; or
- Use the Website to collect information about other users (including email harvesting) for any purpose, including marketing.
3. Intellectual Property
All content on the Website — including program descriptions, photographs, illustrations, logos, videos, text, layout design, source code, and marketing materials — is owned by or licensed to Anderson College of Health, Business and Technology Inc. and is protected by applicable Canadian and international copyright, trade-mark, and other intellectual-property laws. "Anderson College," the Anderson College shield, the "140+ Years of Making Dreams Come True" mark, and related brand marks are trade-marks of the College. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to view and temporarily cache pages for your own information purposes. Any other use — including reproduction, distribution, modification, public display, performance, or creation of derivative works — requires our prior written authorisation.
4. User Submissions and Communications
When you submit information through a form (for example, Request Information, Book Appointment, Career Discovery Quiz, Refer a Friend, or an Alumni Bursary inquiry) you grant us the right to use that information to respond to your inquiry, to determine your eligibility for programs, bursaries, or scholarships, to send you follow-up communications (see our Privacy Policy and Section 5 below), and to share it with our campus admissions advisors and authorised service providers (including our customer-relationship management system, CampusLogin, and attribution-tracking infrastructure). You represent that any information you submit on behalf of another person (for example, a friend you refer) has been shared with that person's knowledge and consent.
5. Marketing, Advertising, and Electronic Messages
Anti-Spam (Canada — CASL). We comply with the Canadian Anti-Spam Legislation (S.C. 2010, c. 23). If you submit your email address or mobile number through a Website form for the purpose of receiving information about our programs, financing options, or campus events, you are providing express consent to receive commercial electronic messages from Anderson College. Each such message will include the sender's identifying information and an unsubscribe mechanism that will be honoured within ten (10) business days of your request.
Implied consent. If you are an alumni or have an existing business relationship with the College, we may rely on implied consent as permitted by CASL to send you relevant updates. You may withdraw this consent at any time.
Advertising accuracy. We take reasonable care to ensure that program descriptions, tuition estimates, career-outcome statistics, and financial-aid information on the Website are accurate at the time of publication. Figures such as "up to $15,000" or "up to $30,000" cited in connection with third-party financing options (Windmill Microlending, Better Jobs Ontario, OSAP, and others) reflect the maximum benefit advertised by the third party as of the effective date above and are subject to change, eligibility, and approval by the third-party administrator. Actual bursary or loan amounts may differ. Programs are subject to Ministry approval, start-date availability, and campus capacity.
Testimonials. Student testimonials, graduate interviews, and career outcomes displayed on the Website are individual experiences and are not a guarantee of future results. Testimonials were provided voluntarily and, where identified by name, with the individual's consent.
Third-party advertising. The Website does not serve third-party advertising or retargeting pixels to the general public. The Website is currently intended for a private audience and is not optimised for search-engine visibility; a noindex, nofollow directive is applied site-wide.
6. Personal Information and Privacy
Our collection, use, and disclosure of personal information is governed by our Privacy Policy and by the Personal Information Protection and Electronic Documents Act (PIPEDA), the Ontario Freedom of Information and Protection of Privacy Act where applicable, and other applicable Canadian privacy laws. We collect only information you voluntarily provide through Website forms plus limited technical metadata (IP address, browser user-agent, referring URL, and UTM parameters) used to attribute the source of your inquiry, to prevent fraud, and to improve the service. We retain lead data only for as long as reasonably necessary to respond to your inquiry and to fulfil our admissions obligations, and we do not sell or rent your personal information to third parties.
7. Third-Party Services and Links
The Website may link to third-party websites, services, and tools (including but not limited to the Ontario Student Assistance Program (OSAP), Better Jobs Ontario, Windmill Microlending, the Ontario Job Grant, Canada Revenue Agency resources, Google Maps, YouTube, and our social-media profiles). We provide these links for your convenience only. We do not control, endorse, or assume responsibility for third-party content, privacy practices, advertising, or services. Your use of any third-party service is governed by that party's own terms and privacy policy, and you access them at your own risk.
8. Program Information, Tuition, and Admissions
Program listings, schedules, tuition figures, and financial-aid options are provided for informational purposes and are subject to change without notice. Formal program agreements, tuition amounts, payment schedules, and refund terms are set out in the written Enrolment Contract that a student signs with the College. In the event of any discrepancy between information on the Website and the Enrolment Contract, the Enrolment Contract governs. Completion of a Website form does not constitute an offer of admission, acceptance into a program, or approval of financial assistance.
9. Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS"AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, ANDERSON COLLEGE DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANDERSON COLLEGE, ITS DIRECTORS, OFFICERS, EMPLOYEES, INSTRUCTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU HAVE PAID US IN CONNECTION WITH YOUR USE OF THE WEBSITE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Anderson College and its directors, officers, employees, and agents from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms; (b) your submission of information that infringes or violates the rights of a third party; or (c) your unlawful use of the Website.
12. Accessibility
Anderson College is committed to providing an inclusive digital experience in accordance with the Accessibility for Ontarians with Disabilities Act, 2005 (AODA) and the Web Content Accessibility Guidelines (WCAG 2.1 AA). 13. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. The "Last updated" date above reflects the most recent revision. Material changes will be posted on the Website and, where required by law, communicated to you directly. Your continued use of the Website after changes take effect constitutes your acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any action or proceeding arising out of or relating to these Terms or the Website shall be brought exclusively in the courts of the Province of Ontario sitting in the City of Toronto, and you irrevocably consent to the personal jurisdiction of those courts.
15. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, unenforceable, or contrary to law, that provision shall be severed to the extent necessary and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any Enrolment Contract or other written agreement between you and the College, constitute the entire agreement between you and Anderson College with respect to your use of the Website and supersede all prior communications.
